Welcome to The Diminished Chord! These Terms of Service ("Terms") govern your access to and use of our game and services. By playing the game or creating an account, you agree to these Terms.
1. Acceptance of Terms
By accessing or using The Diminished Chord ("Game"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Game.
2. Eligibility
- You must be at least 13 years old to create an account.
- If you are under 18, you must have parental or guardian consent.
- You must have the legal capacity to enter into these Terms.
3. Account Registration
- You may play as a guest or create an account to save progress.
- You are responsible for maintaining the security of your account.
- You must provide accurate information when registering.
- One account per person; multiple accounts may be suspended.
4. Game License
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Play the Game for personal, non-commercial entertainment
- Create and share custom levels within the Game
- Participate in community features and leaderboards
5. User Content
5.1 Your Content
When you create content (custom levels, reviews, etc.), you:
- Retain ownership of your original creative work
- Grant us a license to display, distribute, and promote your content
- Agree that your content may be played by other users
5.2 Content Guidelines
Your content must not:
- Contain offensive, discriminatory, or harmful material
- Infringe on others' intellectual property rights
- Include personal information of others without consent
- Promote illegal activities
- Contain malicious code or exploits
6. Prohibited Conduct
You agree NOT to:
- Cheat, hack, or exploit bugs for unfair advantages
- Use bots, automation, or third-party tools to manipulate gameplay
- Harass, threaten, or abuse other players
- Impersonate others or create misleading accounts
- Attempt to access others' accounts or data
- Sell, trade, or transfer accounts or in-game items
- Reverse engineer, decompile, or modify the Game
- Circumvent any technical measures we employ
7. Intellectual Property
The Game, including all content, features, music, artwork, and code, is owned by JS Creativ and protected by copyright and other intellectual property laws. The "Diminished Chord" name, logo, and related marks are our trademarks.
8. Premium Features & Purchases
- Some features may require payment or subscription.
- All purchases are final unless otherwise stated.
- Virtual items have no real-world value and cannot be exchanged.
- We reserve the right to modify pricing and offerings.
9. Advertising
The Game may display advertisements. By using the Game, you consent to receiving ads. Premium features may provide an ad-free experience.
10. Termination
We may suspend or terminate your account for:
- Violation of these Terms
- Conduct harmful to other users or the Game
- Extended inactivity
- Legal or regulatory requirements
You may delete your account at any time through your profile settings or by contacting us.
11. Disclaimers
THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:
- Uninterrupted or error-free service
- That defects will be corrected
- The accuracy of any content
- Compatibility with all devices
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE GAME.
13. Changes to Terms
We may update these Terms periodically. Continued use of the Game after changes constitutes acceptance of the new Terms. We will notify you of significant changes.
14. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
